Is There a Maximum Late Fee in Illinois?

There's no legal limit on late fees for rent in Illinois, but landlords can only charge them if the amount is spelled out in the lease.


Landlords in Illinois are allowed to charge a late fee if you pay rent behind schedule. They can also charge you for anything extra they had to do in order to collect the rent, like follow up several times or send a notice via certified mail. There's no hard limit on how much they can fine you, although it should be "reasonable."

One major caveat: Illinois landlords can only charge late fees if they explicitly mention them in the lease. The lease must include both how much the landlord will charge and when the charge will be triggered.
