When Can a Landlord Increase My Rent in Illinois?

There's no rent control in Illinois, meaning your landlord can increase the rent as much as they'd like when your lease is up.


Illinois state law prohibits rent control across the board, so cities do not have the power to enact rent control measures. That means landlords can legally raise your rent as much as they want. However, a tenant with a fixed-term lease cannot have their rent increased until the lease term has come to an end, unless the lease specifically allows for it. A landlord can increase the rent for a month-to-month tenant whenever they'd like.

State law doesn’t specify the amount of notice that a landlord must give to increase the rent. In cases like this, a landlord hoping to increase a month-to-month tenant’s rent must provide the same amount of notice as they would give to terminate a month-to-month tenancy. In that case, Illinois law demands that 30 days’ notice be provided.
