Managing a Security Deposit in Ohio

In Ohio, there is no limit to the amount you may charge as a security deposit. The standard security deposit amount is equal to one month's rent.

Storing the Deposit

For a sublease that lasts longer than 6 months, any security deposit greater than one month's rent must be kept in a bank account that earns interest.

Returning the Deposit

You must return your subtenant's security deposit within 30 days of the end of the sublease. You can use the security deposit to cover any unpaid rent at the end of the sublease or to cover the cost of any damages to the unit that exceed normal wear and tear. You must provide your subtenant with a written, itemized list of any amount you plan to withhold from the deposit within 30 days of the end of the sublease. This list must be sent to your subtenant in the mail, to an address your subtenant provided to you. If you fail to provide notice and the deposit, if any is owed, within 30 days, your subtenant may take you to court for the amount wrongfully withheld plus attorney's fees. If your subtenant does not provide you with a forwarding address, they forfeit the right to take you to court.
