How to Hold and Return a Security Deposit in Oregon

Managing a Security Deposit in Oregon

In Oregon, there is no legal limit on the amount you may charge as a security deposit. The standard amount is one months' rent.

Storing the Deposit

There is no state law determining where or how you must store the security deposit. Many states require you to keep it in a bank account separate from your personal finances.

Returning the Deposit

You can keep all or some of a subtenant’s security deposit if the unit is returned to you with damages that exceed normal wear and tear or to cover unpaid rent. You have 31 days after the end of the sublease term to return the security deposit. If you plan to withhold any or all of the security deposit for these reasons, you must provide your subtenant an itemized list of the damages and the cost of the repairs. If you do not return any or all of the security deposit within 31 days, your subtenant can take you to small claims court and potentially be awarded twice the amount withheld.
